1. Agreement to Terms

By accessing or using vibeam.dev ("the Site") or any services provided by vibeam ("the Service", "we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

vibeam provides software development services on a subscription basis. Subscribers can submit unlimited development requests which are fulfilled by our team. We also provide AI-generated project previews and proposals through our website as a demonstration of our capabilities.

3. Subscription Terms

3.1 Billing

Subscriptions are billed monthly at the rate displayed on our pricing page at the time of purchase. Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

3.2 Request handling

Requests are worked on one at a time (or more, depending on your plan). We aim to complete most requests within 48 hours, but turnaround times may vary based on complexity. Turnaround time estimates are not guarantees.

3.3 Revisions

Revisions are unlimited within your active subscription. We will continue to refine deliverables until you are satisfied. Revisions must relate to the original request scope.

3.4 Pausing

You may pause your subscription at any time. When paused, your billing cycle is frozen and resumes when you unpause. Unused days within a billing cycle are preserved. Work in progress will be completed before the pause takes effect.

3.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to all deliverables produced during your subscription. No refunds are provided for partial months, except as described in our satisfaction guarantee.

3.6 Satisfaction guarantee

If you are not satisfied with our service within the first 7 days of your initial subscription, you may request a full refund by contacting us at hello@vibeam.dev. This guarantee applies to first-time subscribers only.

4. Intellectual Property

4.1 Work product

Upon payment, you own all rights to the work product (code, designs, assets) we deliver to you as part of your subscription. We retain no ownership rights over deliverables once paid for.

4.2 AI-generated previews

AI-generated previews and proposals provided through our website are for demonstration purposes only. They are conceptual representations and do not constitute deliverables. We make no guarantees that the final product will match the AI-generated preview. Previews are automatically deleted after 30 days.

4.3 Pre-existing materials

We may use open-source libraries, frameworks, and tools in our work. These retain their original licenses. We will not use proprietary third-party code without proper licensing.

4.4 Our brand

The vibeam name, logo, and branding are our property. You may not use our trademarks without prior written permission.

5. Your Responsibilities

• Provide clear, accurate project descriptions and requirements.
• Respond to questions and provide feedback in a timely manner.
• Ensure that content you provide for inclusion in deliverables does not infringe on third-party rights.
• Do not use our services for any illegal, harmful, or fraudulent purpose.
• Do not attempt to abuse, exploit, or reverse-engineer our AI preview system.
• Do not submit malicious content, prompt injection attacks, or content designed to produce harmful outputs.
• Keep your account credentials and payment information secure.

6. Acceptable Use

You agree not to use our services to:

• Build products that are illegal or promote illegal activities.
• Create malware, spyware, or any software designed to harm users.
• Build phishing sites, scam pages, or fraudulent applications.
• Infringe on the intellectual property rights of others.
• Build products that violate applicable data protection laws.
• Spam, harass, or abuse our team or systems.

We reserve the right to refuse or terminate service for any project that violates these terms, at our sole discretion. No refund will be provided for terminations due to acceptable use violations.

7. AI-Generated Content Disclaimer

Our website uses AI (powered by Anthropic's Claude) to generate project previews and proposals. This content is automatically generated and is provided "as is" for illustrative purposes. AI-generated previews are not guaranteed to be accurate, complete, or representative of the final deliverable. They should not be relied upon as a specification or commitment. Final scope, design, and deliverables are determined through direct consultation with our team.

8. Limitation of Liability

To the maximum extent permitted by law, vibeam shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of our services, regardless of whether we have been advised of the possibility of such damages.

Our total liability for any claim arising from or related to our services shall not exceed the total amount you have paid to us in the three (3) months preceding the claim.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

10. Indemnification

You agree to indemnify, defend, and hold harmless vibeam and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of our services; (b) your violation of these terms; (c) your violation of any third-party rights; or (d) any content you provide to us for inclusion in deliverables.

11. Confidentiality

We treat all project details, business information, and communications shared with us as confidential. We will not share your project information with third parties except as necessary to provide our services (e.g., sending your prompt to Anthropic for preview generation) or as required by law. This obligation survives termination of services.

12. Dispute Resolution

Any disputes arising from these terms or our services shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration in accordance with applicable arbitration rules. Each party shall bear its own costs for arbitration.

13. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and confidentiality survive termination.

14. Changes to Terms

We may modify these terms at any time. We will notify active subscribers of material changes via email. Continued use of our services after changes are posted constitutes acceptance of the updated terms. If you do not agree with the changes, you may cancel your subscription.

15. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and vibeam regarding your use of our services, and supersede all prior agreements and understandings.
